Recent changes to the Employment Standards Act, 2000 (the “ESA”) will soon impact those who operate temporary help agencies (“THAs”) and recruiting firms, as well as those who use their services (the “Client”).
Effective July 1, 2023, a licensing regime for THAs and recruiters will be open for applications. Operating as a THA or recruiter beyond January 1, 2024, without a license to do so, will be a violation of the ESA subject to fines. Further, using the services of a THA or recruiter, if it is known that they do not have a license, will expose the Client to the same fines.
